Joint Contracts Tribunal (JCT) contracts are a popular way of outlining the responsibilities of the parties involved in a construction project, setting out the basis of what is expected of them.
The JCT provides a suite of standard construction contracts that are widely used by those in the industry. We act for employers, contractors, sub-contractors and members of the professional team when negotiating JCT contracts as well as dealing with disputes that may arise.
While a JCT contract is in a standard form, details of each contract will need to be added. In many cases the terms of the JCT contract itself will need to be amended. Our construction team can negotiate on your behalf to ensure that the terms and conditions that are agreed protect your interests as far as possible.
We will ensure that the document adequately details what is expected of each party, to minimise the risk of disagreements and misunderstanding.
Construction contracts are notoriously complex, with substantial scope for disputes to arise, especially if they do not accurately reflect the agreement that the parties intended to enter.
An expert construction solicitor will be able to advise you on the legal liabilities and risks that you are taking on and help ensure that these legal risks are explained to you. If you ask us to represent you, we will work with you and other members of your team to ensure that your requirements are accurately stated. That way each party is clear on the services and payments to be provided and at what stage they are triggered. The contract will also include details of how any disputes will be resolved, which can help minimise the likelihood of costly legal proceedings in the future.
Our construction team have in-depth expertise in the sector and can advise you across a range of contracts issues, including the following:
