Do Step-Parents Have Parental Responsibility? And How Can They Obtain it?

Family young same sex family with boy happy 716726290

If you wish to make a court application for parental responsibility, you need to be closely connected to the child, for example, be their father, step-parent, or second female parent. The court will look at a number of issues, including the following:

  • The level of commitment the applicant has shown towards the child, for example, by way of financial support, contact, and involvement in the child’s life;
  • Whether the status of the birth father is in dispute;
  • The amount of attachment between the applicant and the child;
  • The reason for the application.

Understanding Parental Responsibility for Step-Parents

Step-parents often play a significant role in a child's upbringing but do not automatically have parental responsibility. This means they cannot make key decisions or handle matters like signing school consent forms without obtaining legal recognition.

How Step-Parents Can Gain Parental Responsibility

To acquire parental responsibility, a step-parent must generally meet the following criteria:

  • Relationship Status:
    Be married to or in a civil partnership with the biological parent with whom the child resides.
  • Consent:
    Obtain agreement from all individuals who currently have parental responsibility for the child.

A solicitor can assist in preparing the necessary paperwork and obtaining court approval. This step is typically straightforward if all parties are in agreement.

When There's Disagreement

If someone with existing parental responsibility disagrees with the application, you can request a court decision. The court will prioritise the child's best interests, considering factors such as the child's feelings if they are mature enough to express them.
