Commercial Agents Agreements
In general terms, Commercial agents are individuals who sell your goods on their Principals’ behalf. They are paid a commission consistent to the value of sales they achieve. The advantage of appointing a commercial agent is to use the skills of an established sales person to sell on a Principal’s behalf in a new territory.
This brings in customers to the Principal that would not have had otherwise.
Commercial agents have received legal protection since the mid 1990s by virtue of the Commercial Agents (Council Directive) Regulations 1993 (the Regulations). It is important that whether you are the company seeking to employ an agent (i.e. the Principal) or the Agent you have a good understanding of the Regulations.
Failure to do so will cost you money.
